The headline is that enforcement reached the consent chain and the location of data. Norway's Xandr fine was NOK 92M, decided October 2, and the Texas settlement with Temu was announced October 16. Japan was the volume story, with 454 leaks from January to September. Only one new binding rule took effect, the GSA class deviation on October 19, so most exposure sits in drafts, claims and late counts. Treat adopted and in-force instruments as obligations, and everything else as dated risk. Next, the EU fine in detail.

EU · Fines|Own your upstream consent after the Xandr fine

    Notas del orador

Starting with the EU: you own your upstream consent. Norway's Datatilsynet fined Xandr NOK 92M, about EUR 8.6M, on October 2, holding that a joint controller cannot rely on another party's invalid consent. That is about 1.4 times Grindr's NOK 65M fine, and appeal status is not stated. Separately, the EDPB draft guidelines on fines are only a draft, with comments open to November 13, but they read as a strong presumption to fine. So verify upstream consent covers your own processing. Next, the US side, where settlements now fix where data lives.

    What the decision says

Xandr fined NOK 92M on Oct 2: Norway's Datatilsynet held that a joint controller cannot rely on another party's invalid consent in real-time bidding on Grindr users. Appeal status is not stated.

About 1.4 times Grindr's NOK 65M fine, under GDPR Articles 6(1) and 9(1).

Italy's Garante supplied most other amounts: only Wind Tre was published inside the window (reported); IQVIA, BBVA and Emirates were listed Oct 9 (context). The four sum to about EUR 29.4M.

EDPB draft Guidelines 04/2026 are a draft in consultation, with comments to Nov 13.

Consequence: the draft reads as a strong presumption to fine non-minor infringements, so relying on a partner's consent is a fineable risk .

    Fines compared (EUR M)

Read: Xandr is second to Wind Tre (reported)

    Next step

Verify that upstream consent is valid and covers your own processing

Comment on the EDPB draft by Nov 13 ; Italian email-pixel guidelines are enforceable Oct 29

US · Settlements|Check where data lives and how opt-outs work

    Notas del orador

In the US, remedies now fix where data lives. Texas announced a settlement with Temu on October 16: data on US-owned servers, China access restricted, and $3M plus $8M for each year of violation. In California, a trade-press estimate counts five 2026 CCPA settlements at $17.1M, against $7.9M for nine in 2022 to 2025. General Motors' $12.75M is about 75% of that total, and twelve of 14 settlements involved opt-out handling. The material shows no FTC privacy action in the window. So document data location, access routes from abroad and opt-out handling. Next, Japan's leaks.

    Japan · Leaks|Check internet-facing apps after 454 leaks

    Notas del orador

Japan shows what happens when internet-facing apps stay exposed. Asahi Shimbun reports MM Research counted 454 leaks from January to September, 1.5 times a year earlier. Yamato Transport disclosed 5.31 million records on October 16, and H2O Retailing said on October 19 that about 1.26 million accounts may be exposed. On October 20, IwaiCosmo Securities reported unauthorized trades affecting 4,975 people, and restored the accounts. Experts point to known vulnerabilities and configuration errors, so inventory your internet-facing apps and fix those first. Next, why breach counts arrive weeks late.

    Notas del orador

After Japan's leaks, this page shows that the first public number understates the final one. CenterPoint Energy's Sept 14 8-K gave no count, and a Texas attorney general listing in the week of Oct 12 showed 1,062,060 Texas residents, which is reported. A forum poster's 7.49M records claim is unverified, so it is only claimed. ETS notices to California students began Oct 16 with no student count. OCR data shows 77 US healthcare breaches in July, affecting 33,485,970 people. So plan notification on the first facts, and update the count as the investigation closes. Next, the rules on moving data across borders.

Cross-border|Keep a DPF fallback; only GSA's clause is new

    Notas del orador

Having seen how counts arrive late, we turn to where data may legally travel. The EU-US Data Privacy Framework stays in force after Trump v. Slaughter, decided Jun 29, which is context. Its independence pillar is contested, and under review is only reported, because the material holds no Commission statement. Safe Harbour lasted 15 years and Privacy Shield 4 years before invalidation, and the DPF dates from 2023, so its political risk has not been removed by any official reassessment. The only rule taking effect in the window is GSA's class deviation on Oct 19, with 72-hour notice, for GSA contractors only. Keep a DPF fallback. Next, how attackers reach the data.

Read-out: Safe Harbour lasted 15 years and Privacy Shield 4 years before invalidation; the DPF dates from 2023.

Transfer rules set where data can go; this page asks how attackers get to it, and exploitation, not severity score, should set your patch queue. CISA added 15 CVEs to KEV across five alert days from Oct 13 to Oct 20, and the Oct 20 batch of six flaws held none at 9.0 or above. Ivanti Connect Secure CVE-2026-104935 and BeyondTrust CVE-2026-102764 are exploited. Unit 42, in a vendor attribution, names Qilin and INC as using PAN-OS CVE-2026-0257. The SafePay advisory of Oct 20 counts at least 600 victims and lists Veeam CVE-2023-27532, so backup servers are a shared target. Patch internet-facing KEV flaws and Veeam first. Ivanti Connect Secure zero-day CVE-2026-104935 and BeyondTrust CVE-2026-102764 are exploited; Ivanti 22.8 reaches end of life Jan 31, 2027 (announced)

PAN-OS CVE-2026-0257 (CVSS 7.8, patched May 13): Unit 42 names Qilin and INC (vendor attribution)

SafePay advisory AA26-293A (Oct 20) lists five exploited CVEs, including Veeam CVE-2023-27532

Consequence: exploitation evidence, not severity, set the patch queue, and backup servers are a shared target.

Next step: patch internet-facing KEV flaws and Veeam first, and use MFA, offline backups and segmentation.

Those were edge devices; this page moves to code and packages. Details of two unauthenticated RCE flaws in PHP core leaked on Oct 20, rated CVSS v4.0 9.2, and the fix came Oct 21 in PHP 8.5.12, 8.4.27, 8.3.36 and 8.2.35, while 8.1 and older get no updates. An attempt was logged on Oct 17, but widespread exploitation is not independently confirmed, as reported Oct 22. LiteLLM 1.107.0 reached PyPI on Oct 21, apparently through stolen GitHub tokens, and was live for about 104 minutes. Provenance shows where a package was built, not that it is safe. So move PHP to a fixed version, pin dependencies and rotate exposed credentials. Last, the dates ahead.

    Notas del orador

With the attack picture complete, here is what to plan for: most dated items fall after Oct 24. On Oct 29 the Italian email-pixel guidelines become enforceable. Nov 3 is the CISA due date for the rest of the Oct 20 KEV batch. Comments on the EDPB draft Guidelines 04/2026 close Nov 13, and the ICO call for evidence on agentic AI closes Nov 20. A missed consultation date cannot be recovered. The GSA clause, the SafePay advisory and the fixed PHP versions are already in effect. Security teams patch by Nov 3, privacy officers add pixel consent and comment, executives review the DPF. That closes this issue.

1. Key takeaways from the two weeks

Between Oct 10 and Oct 23, 2026, privacy and security news was driven by enforcement that dictates how data is handled, by incidents whose counts arrived late, and by old flaws used on edge systems. Five conclusions explain the period; each is supported in the chapter named in brackets, with every fact judged against Oct 24.

1. Enforcement now reaches the consent chain and the location of data. Norway's Datatilsynet fined Xandr NOK 92M, about EUR 8.6M, in a decision of Oct 2 under GDPR Articles 6(1) and 9(1), holding that a joint controller cannot rely on another party's invalid consent. Texas settled with Temu on Oct 16 for $3M plus $8M for each year a data-security provision is violated, and the remedy fixes where the data lives. In California, five 2026 CCPA settlements total $17.1M against $7.9M for nine in 2022-2025, a trade-press estimate. The EDPB draft Guidelines 04/2026 on fining take comments until Nov 13. [Chapter 2]

2. Breach counts arrive weeks after the disclosure, and Japan is the volume story. Yamato Transport put its exposure at 5.31M records on Oct 16, and MM Research counted 454 Japanese leaks from January to September, 1.5 times a year earlier. CenterPoint Energy's Sept 14 8-K gave no count, and a Texas attorney general listing later showed 1,062,060 Texas residents. OCR data shows 77 US healthcare breaches in July affecting at least 33,485,970 people. In California, ETS files on students of the last three school years were copied between May 22 and Sept 18, and notices began on Oct 16. [Chapter 3]

3. Cross-border rules held still; the one binding change is procurement. The EU-US Data Privacy Framework stays in force after Trump v. Slaughter (Jun 29), but its independence pillar is now contested, and the material holds no official reassessment. The only rule taking effect in the window is GSA's class deviation, effective Oct 19, which sets 72-hour notice of material violations. A report that the Commission confirmed Japan's adequacy on Oct 14 rests on one secondary source. Elsewhere, Kenya’s guidance covers two of four EU SCC modules, and a Thai draft act on localisation is still only a draft. [Chapter 4]

The window rewarded basics: show that upstream consent is real, know where data sits, and patch what is already being exploited.

4. Attackers keep using old flaws on edge and backup systems. CISA added 15 CVEs to KEV across five alert days from Oct 13 to Oct 20, and the Oct 20 batch peaked at CVSS 8.6. Qilin and INC exploit PAN-OS CVE-2026-0257 (CVSS 7.8), patched on May 13, and use Veeam CVE-2023-27532. The SafePay advisory AA26-293A of Oct 20 counts at least 600 victims and lists the same Veeam flaw among five CVEs. Comparitech counts 306 healthcare ransomware attacks in Q3 2026, up 40% on Q2. Palo Alto did not say how many organizations were hit. [Chapter 5, Chapter 3]

5. Risk from new code now moves in hours. The PHP2Shell flaws (CVSS v4.0 9.2) were patched on Oct 21 after an early leak; an attempt was logged on Oct 17, but widespread exploitation is not independently confirmed. PHP runs on 69.3% of sites with a known server-side language. LiteLLM 1.107.0 stayed on PyPI for about 104 minutes after an upload through accounts apparently reached with stolen tokens. [Chapter 5]

2.2 Norway fines Xandr: consent cannot be outsourced

Datatilsynet's final decision of Oct 2, 2026 fined Xandr Inc. (formerly AppNexus, owned by Microsoft) for real-time bidding on Grindr users in Norway. The EDPB summary names GDPR Article 6(1), no legal basis, and Article 9(1), sexual-orientation data without a valid exemption. The authority found Xandr was a joint controller, relied on Grindr's consent, and that this consent was invalid under Articles 4(11) and 7.

"Compliance can never be outsourced": each joint controller must itself verify that consent is valid and covers its own processing (Datatilsynet, via Skanopy).

The amount is NOK 92M, about EUR 8.6M at the authority's conversion, an implied rate of 92 ÷ 8.6 ≈ 10.7 NOK per EUR. Servola notes that noyb quotes EUR 8.5M; we follow the authority's EUR 8.6M. Skanopy calls it Datatilsynet's highest ever, about 1.4 times Grindr's own NOK 65M fine of 2021 (92 ÷ 65 ≈ 1.42), which was upheld on appeal on Oct 21, 2025. According to Servola, the amount was set on Xandr's own turnover, not Microsoft's.

Dates conflict. Skanopy and Servola place the announcement on Oct 12, while pii.ai and SCLA say the EDPB published it on Oct 16. We follow the EDPB's Oct 2 decision date and treat both later dates as publication. On appeal, Microsoft told BleepingComputer it is "reviewing the decision and assessing its options" (reported via Servola), and the appeal window is three weeks from receipt. The receipt date is not stated, so the deadline cannot be computed and the status is open.

2.3 EU rules: the fining default and Italian activity

The EDPB adopted draft Guidelines 04/2026 on Sep 17 and opened consultation on Sep 21 (Bird & Bird), with comments open until Nov 13, 20 days from Oct 24. Crowell & Moring dates publication to Sep 17; we follow Bird & Bird. The guidelines are not binding and replace 2017 Article 29 Working Party guidance.

The five steps ask whether the infringement is fineable, the party can be fined, it was intentional or negligent, it is minor, and a fine would be effective, proportionate and dissuasive. Per Bird & Bird, negligence exists if the company was in a position to know its conduct was unlawful, and legal advice is no safe harbour if it departs from known authority positions. For non-minor infringements Crowell reads the draft as a strong presumption to fine. The ceilings stay EUR 20M or 4% of worldwide turnover, and EUR 10M or 2% for lesser obligations.

Italy's Garante supplied most other EU amounts. Decisions the EDPB listed on Oct 9-12:

Garante decision Fine Decision date Source
Wind Tre, telemarketing EUR 16.7M Not stated (EDPB listing Oct 12) EDPB
IQVIA Solutions Italy, "anonymous" patient database EUR 7M Sep 23 pii.ai
BBVA, ignored marketing opt-out EUR 5.5M Jul 3 pii.ai
Emirates, health-data form EUR 180,000 May 14 pii.ai

Only Wind Tre was published inside the window; the other three were listed on Oct 9, a day before it opened. The four sum to about EUR 29.4M (16.7 + 7 + 5.5 + 0.18). The Garante held that IQVIA's persistent identifier defeated its anonymity claim. Separately, Garante email-tracking-pixel guidelines become enforceable on Oct 29, as pixels generally need prior, specific consent.

For context, Ireland's DPC fined Google EUR 403M on Sep 21 over location data and ordered compliance within six months, about Mar 21, 2027. According to shattered.io, Google intends to appeal.

The EDPB's Oct 13 smart-glasses statement says manufacturers are controllers in their own right and cannot push duties onto wearers.

2.4 United States: settlements that dictate data location

On Oct 16, Texas Attorney General Ken Paxton announced a settlement with Temu (PDD Holdings and WhaleCo), resolving a February 2026 lawsuit. According to pii.ai, Temu must keep Texans' personal data on US-owned and controlled servers and restrict access from China, pays Texas $3M, and faces $8M for each year a data-security provision is violated. The remedy fixes where data lives, not just what is disclosed. The attorney general's own release is not in the material.

California is the volume story. Clym counted 14 CCPA settlements through Sep 29; five in 2026 total $17.1M, against $7.9M for nine in 2022-2025. General Motors' $12.75M (May 8) is 12.75 ÷ 17.1 ≈ 75% of 2026's total. The other four average (17.1 - 12.75) ÷ 4 ≈ $1.09M, against 7.9 ÷ 9 ≈ $0.88M before 2026. Twelve of the 14 involved opt-out handling. This is a trade-press count (estimate).

In the window CalPrivacy reported 560,000+ DROP registrants, close to 100M profiles deleted and 660-plus brokers. Recent rules are context: SB 690 (signed Sep 30) leaves only the Attorney General able to bring CIPA pen-register actions over websites from Jan 1, 2027, and SB 923 widens deletion rights from the same date.

The material shows no FTC privacy or data-broker enforcement action in the window. It reports only a Section 6(b) personalized-pricing study, announced in the week of Oct 5-11 (exact date not stated).

3. Major security incidents

Chapter 2 covered what regulators decided; this chapter covers the incidents that will feed their next cases, as disclosed between Oct 10 and Oct 23, 2026.

3.1 Incidents at a glance

3.2 Japan: a surge of consumer-data thefts

Asahi Shimbun (Oct 19) says Japanese companies are "disclosing massive data breaches almost daily". On Oct 16, Yamato Transport said a cyberattack first disclosed in September exposed 5.31 million records. On Oct 19, H2O Retailing said unauthorized access to a Hankyu Hanshin Department Stores website may have exposed about 1.26 million H2O ID accounts, "almost the entirety" of its membership database. The data includes names, contact details, birthdates and the last four card digits. Dates are not stated for the earlier Estore case (about 23.35 million people; 2.09 million with some card data).

Two cases differ in kind. IwaiCosmo Securities announced on Oct 20 that attackers in its online trading system placed unauthorized trades and exposed names and email addresses of 4,975 people. It said it restored the accounts to their pre-trade state, so customers had no losses, and that the trades were unrelated to the leaked data. A professor emeritus at Kobe University knew of no earlier Japanese case of manipulated transactions at a financial institution. Police forces reported on Oct 21 that staff data may have been exposed through disaster-app provider Arcadia: Kanagawa about 16,000, Saitama 13,000, Fukuoka 11,000, Aichi 15,000, Kagoshima 2,200 and Tochigi 3,900. The sum is 16,000 + 13,000 + 11,000 + 15,000 + 2,200 + 3,900 = 61,100 (our arithmetic; the figures are possible exposure, not confirmed theft).

The aggregate data shows a step change. MM Research counted 454 leaks from January to September, 1.5 times a year earlier, and by mid-October 19 cases involved at least 1 million records, more than any full year since 2022 (reported by Asahi). A security blog reports that TV Asahi counted more than 40 announcements in about a month to Oct 8, and that the IDC Frontier cloud ransomware attack of Oct 7 hit 495 companies and local governments. Both events fall before the window, and none of the disclosures the blog read names an attacker. The government had not linked the incidents as of Oct 6. Experts quoted by Asahi point to a common method: attackers go for flaws in internet-facing apps and "known vulnerabilities or configuration errors" rather than long network intrusions. The Personal Information Protection Commission said on Oct 14 that "some basic security measures are being overlooked".

Japan's wave is mostly front-door theft of consumer data, not exotic intrusion, and the one case that reached a trading system on Oct 20 shows the next step.

One ransomware claim sits in the window. Keio Corp. said it had confirmed that Qilin claimed to have published some personal data taken from a group company (claimed; date not stated).

3.3 US utilities and schools: the count arrives late

CenterPoint Energy filed an 8-K on Sept 14 saying a third party obtained personal information on "a portion" of customers through an external-facing system, after an online post claimed the data. It gave no count. A Texas AG breach listing, reported in the week of Oct 12, shows 1,062,060 Texas residents, with names, addresses, Social Security information and driver license numbers. It records that consumers had not yet been notified. On Oct 14 the company said its investigation was continuing. A forum poster claimed 7.49 million records from a CenterPoint API. CenterPoint has not verified this (claimed), and the two figures measure different things: 7.49M ÷ 1.06M ≈ 7.1 times, but one counts Texas residents and the other claims records in any state. The material holds no primary filing, only this law-firm page.

ETS and the California Department of Education reported the window's largest student-data incident. An unauthorized party used a compromised login on an ETS file-transfer site to copy student files between May 22 and Sept 18, 2026, about 119 days (9 + 30 + 31 + 31 + 18). ETS identified it on Sept 25. CDE confirmed it to districts on Oct 16, and notices began that day and run to early November. The files cover students enrolled in the last three school years, some who left since 2006, with names, birth dates, addresses, disability status and test results, but exclude Social Security numbers, financial data and passwords. ETS offers 24 months of Experian IdentityWorks with a March 19, 2027 deadline, and says it found no sign the data was made public (status: notifying). KCRA says the breach "happened on Sept. 25"; we follow the district pages quoting CDE, where Sept 25 is the discovery date. No count of students is in the material. Summit School District (Vermont) also filed a notice in October 2026 covering Social Security and card data; the day and the count are not stated (law-firm page).

3.4 Healthcare and the ransomware tallies

The OCR portal data, summarized by HIPAA Journal (page dated Oct 15) and echoed by calHIPAA on Oct 19, shows 77 large breaches in July affecting at least 33,485,970 people, 642% above June and 154% above the 12-month average of 13.2M. Four breaches account for 15,000,000 (estimate) + 9,540,683 + 3,803,750 + 3,756,469 = 32,100,902, about 96% of the month. They are DentaQuest (ShinyHunters claimed 234 GB), Aesto, Unlimited Technology Systems and CareCloud; three of the four are business associates. Hacking and IT incidents were 67 of 77 breaches (87%).

Comparitech (updated Oct 15) counts 306 ransomware attacks on healthcare in Q3 2026, up 40% from 219 in Q2 and more than double Q3 2025's 151; 306 ÷ 92 days is 3.33 a day. Of these, 192 hit care providers and 114 hit healthcare businesses. Vendor tallies disagree because they count different things. Check Point (Sept 2026) reports ransomware up 53% year on year, Bitdefender counts 790 claimed victims (+30%), and Fortinet counts 7,831 against about 1,600 (+389%, our check: 6,231 ÷ 1,600) (via Tech Insider). The agency-led SafePay advisory of Oct 20 is covered in Chapter 5.

4. Cross-border data rules

Chapter 3 covered what was taken from companies; this chapter covers the rules on where data may legally go, and the window brought commentary and one new binding clause rather than a new treaty-level instrument.

4.1 Rules at a glance

Thailand draft Digital Infrastructure Service Business Act Localisation comments Oct 15 Draft bill Global Data Alliance

4.2 The Data Privacy Framework: in force, with a weaker pillar

The DPF is the current EU adequacy decision for the US, and it survived the window intact. The US Supreme Court held in Trump v. Slaughter on June 29, 2026 that FTC Commissioners can be removed at will. That matters because the Commission's DPF decision cited statutory limits on removal as support for the FTC's independence, a factor GDPR Article 45(2)(b) requires it to weigh.

Per HLC (Oct 20), noyb urged an "orderly exit" from the DPF, the EDPB asked the Commission to "closely assess" the effect (date not stated), and some Member States have opened investigations. HLC argues the DPF can survive: the ruling neither annuls the decision nor removes the FTC's enforcement power, and EU law demands essential equivalence, not a mirrored institution. KU Leuven's CiTiP blog (Oct 13) adds that the General Court dismissed MEP Philippe Latombe's annulment action (Case T-553/23), so the DPF "for the time being" remains in force; appeal status is not stated. Alston & Bird held a panel on Oct 20 asking whether elected state attorneys general, who are not removable by the President and are elected in 43 states, could count toward equivalence. The material holds no Commission statement, so "under review" is reported, not official.

The history explains the nervousness. Using CiTiP's dates:

Framework Adopted Invalidated Lifespan
Safe Harbour 2000 2015 (Schrems I) 2015 − 2000 = 15 years
Privacy Shield 2016 2020 (Schrems II) 2020 − 2016 = 4 years

The DPF dates from 2023, so it is about three years old on the same count (2026 − 2023). Both predecessors fell on equivalence grounds.

The DPF is lawful today, but its independence pillar is now a political question, and no official reassessment was published in the window.

4.3 Adequacy and transfer toolkits elsewhere

Japan. According to the Lawxy Times, the Commission decided on Oct 14, 2026 (cited as COM/2026/0459) that Japan's adequacy decision continues to apply, calling the 2026 APPI amendments non-material after a challenge by Japanese NGOs. This is one aggregator summarising a news item; the material holds no Commission text, so treat it as reported.

Kenya. The ODPC's Guidance Notes for Cross-border Data Transfers (Sept 2026) give operational detail on Part VI of the Data Protection Act 2019 and Regulation 40. They supply standard clauses for controller-to-controller and controller-to-processor transfers only, so two of the EU's four 2021 SCC modules (processor-to-processor, processor-to-controller) have no Kenyan equivalent (4 − 2 = 2). Safeguard-based transfers must be documented and notified to the ODPC. Localisation is limited to six categories, such as elections and basic health care. The EU noted "positive progress" on Kenya's adequacy in June 2026, with no decision yet.

China. Bird & Bird (Oct 14) covers August 2026, so these are context: Shanghai CAC issued data-export guidance for membership, marketing, supply-chain and HR scenarios; Beijing CAC completed the first filing under a banking-sector negative list; and a central Action Plan (2026-2030) backs negative lists in pilot free trade zones. The statutory routes are unchanged: security assessment, standard contract or certification, as adjusted by the March 22, 2024 provisions.

India. Under Section 16 of the DPDP Act read with Rule 15 of the 2025 Rules, transfers are allowed except to countries the government restricts; as of April 2026 none was listed, though Rule 15 lets the government set conditions on making data available to foreign states. No new India transfer instrument appears in the window.

4.4 Localisation: one binding clause, two loosening or drafting signals

The only rule taking effect in the window is a US procurement clause. GSA's class deviation, "Basic Safeguarding of Data within Large Language Model Artificial Intelligence Systems", was finalised Sept 28 and took effect Oct 19, 2026. It bars transmitting, storing or accessing Government Data outside agreed premises or authorised services without written consent, requires contractors to maximise US-developed LLMs, restricts models controlled by adversary foreign governments, and sets 72-hour notice of material violations. It binds only GSA contractors.

Elsewhere, the direction is mixed. The Diplomat (Oct 13) reports Uzbekistan easing its 2021 localisation amendment; the date and text of the change are not in the extract. It cites estimates of costs: CERR puts YouTube-monetisation losses at $50 million a year, and Kotib AI Research puts the law's total cost at $3.2-4.5 billion a year. For scale, the claimed PayPal loss of at least $1.8 billion over five years is 1.8 ÷ 5 = $0.36 billion (about $360 million) a year. In Thailand, the Global Data Alliance on Oct 15 criticised localisation in a draft Act proposed by MP Supachai Jaisamut; its definition of cloud services is tied to data centres located in Thailand. These are lobbying positions on a draft, not law.

CDP's reference table lists mandatory localisation for China, Russia and Vietnam (certain data) and none for the EU/EEA, UK, Brazil or Japan; India has no general rule, only sectoral ones.

5. Attack methods and vulnerability trends

Chapter 4 covered where personal data may legally travel; this chapter covers how attackers reach it, and which flaws set the patch queue from Oct 10 to Oct 23.

Most items are old or ordinary access paths into edge, management or runtime software, not novel techniques.

5.2 Edge devices, KEV and ransomware

KEV batches. The Oct 20 batch held six flaws: four Plex Media Server CVEs (CVSS 5.3, 6.9, 5.3, 8.6), Siemens Software Center CVE-2026-110936 (8.4) and SiteGuard CVE-2026-106931 (8.5), none at 9.0 or above. The Hacker News's opening line says "four"; CISA's alert feed says six, which we follow. Federal civilian agencies had to fix three by Oct 23 (passed) and the rest by Nov 3, 14 days after listing (upcoming). Plex had shipped its fix on Aug 3, 2026. By contrast, according to securityonline.info, Q3 2026 added 100 KEV flaws, up 33.3% from 75 in Q2 (100 ÷ 75 = 1.33), with median CVSS 9.2. Of 58 flaws with a known publish date, 15 (26%) were attacked within seven days.

Ivanti and BeyondTrust. CISA said actors exploit Ivanti Connect Secure zero-day CVE-2026-104935 (25.1.1.1, 25.1.2.2 and 22.8R2.4 and earlier) to steal credentials and data. Commands run in memory, so Ivanti's Integrity Checker may miss them, and version 22.8 reaches end of life on Jan 31, 2027 (announced). BeyondTrust-hosted deployments were already patched; self-hosted versions older than 24.3.1 must upgrade first. Neither alert gives a CVSS score.

PAN-OS and ransomware. Palo Alto patched CVE-2026-0257, a GlobalProtect authentication bypass, on May 13, 2026, and CISA listed it that day. It was first rated medium, and Rapid7 saw exploitation from at least May 17. ReliaQuest reported Qilin and Settra activity on Oct 9, and on Oct 19 Unit 42 named Qilin (Spikey Scorpius) and INC (Tarnished Scorpius). After a VPN session the attackers reached vCenter, disabled ESXi execInstalledOnly and dumped domain controller credentials from its virtual disk, bypassing in-guest EDR; they also used Veeam flaw CVE-2023-27532. Palo Alto did not say how many organizations were hit. The attribution is a vendor's, not law enforcement's.

SafePay. Advisory AA26-293A (Oct 20; FBI, CISA, U.S. Secret Service, German and UK partners) counts at least 600 victims since August 2024. It lists five exploited CVEs: Cisco ASA CVE-2020-3259 and CVE-2023-20269, Veeam CVE-2023-27532 and CVE-2024-40711, SonicWall CVE-2024-40766; WaterISAC notes patches have existed for well over a year. Veeam's CVE-2023-27532 appears in both campaigns, so backup servers are a shared target. CISA urges patching internet-facing KEV flaws, MFA, offline backups and segmentation.

5.3 PHP2Shell: an AI-assisted flaw in the runtime

On Oct 20 details of two unauthenticated RCE flaws in PHP core leaked early. The PHP team rated both critical (CVSS v4.0 9.2) and brought its release forward to Oct 21, 14:00 UTC. Fixed versions (patch GA) are PHP 8.5.12, 8.4.27, 8.3.36 and 8.2.35; 8.1 and older get no updates, apart from minimal backports for 7.4, 8.0 and 8.1. The PHP team says there is no complete mitigation, and mod_php is highest risk.

Discovery is reported two ways. Elastic says Wiz Research reported the flaws with help from frontier AI models; FortiGuard says Calif found the first through AI-assisted code analysis on Aug 1. According to an AWS Builder Center post, Calif used OpenAI's GPT-5.6 Sol. We read it as two independent discoveries.

Exploitation is contested. Amazon Threat Intelligence logged an attempt on Oct 17, four days before disclosure. The AWS Builder post relays Cloudflare's first automated attempts at 07:43 UTC on Oct 21, two minutes after Chainguard published patched images ahead of the embargo. But FortiGuard (Oct 22) says widespread exploitation is not independently confirmed, and watchTowr had seen none. We follow them: attempts are documented, mass compromise is not. PHP runs on 69.3% of sites with a known server-side language (W3Techs, Oct 21).

5.4 Supply chain: stolen tokens, trusted pipelines

LiteLLM 1.107.0 is the window's clearest case. Seven wheels reached PyPI at 11:39 UTC on Oct 21 and were removed at 13:23 UTC, about 104 minutes later. LiteLLM puts Docker Hub cleanup at 14:20 UTC; Kodem says floating tags pointed at it until 17:13. We follow the project and treat Kodem's time as an outer bound. Payload files in Python startup paths (cook.pth, sitecustomize.py) ran without litellm being imported, stole cloud and AI-provider credentials, and polled hourly for code. LiteLLM says three engineers' GitHub accounts were used, apparently via stolen GitHub CLI OAuth tokens; no actor is named and there is no CVE. The last clean version is 1.106.2.

Two nearby items fit. The tensorlake 0.5.144 npm worm (Oct 8, context) carried an npm provenance attestation, which shows where a package was built, not that it is safe. GhostAction, per a Kaseya digest, hit 772 repositories from Aug 31 to Sep 30, then 30,000+ on Oct 8 to 9.

Exploitation evidence, not severity, set the queue: the Oct 20 KEV batch peaked at CVSS 8.6, a five-month-old 7.8 flaw feeds ransomware, and the 9.2 PHP flaw drew probes before its patch.

Patch edge and backup systems on evidence of exploitation, and pin dependencies; provenance alone is not proof.

6. Enterprise protection checklist

Chapters 2 to 5 covered the fines, incidents, transfer rules and attack methods of the two weeks. This chapter turns them into a who-must-do-what table, a what-changed table by reader, and a dated timetable. It uses only facts and measures named in earlier chapters and is not legal advice.

6.2 What changed and what it means by reader

Reader What changed Implication Evidence
Security teams The window's flaws were old or ordinary access paths: KEV added 15 CVEs; PAN-OS CVE-2026-0257 (7.8) feeds Qilin and INC; SafePay lists five CVEs with patches over a year old Rank patching by exploitation evidence, not CVSS, and start with edge and backup systems —
Security teams PHP2Shell (CVSS v4.0 9.2) saw an attempt before patch; LiteLLM 1.107.0 was live about 104 minutes Pin dependencies; provenance alone is not proof of safety —
Privacy officers Xandr was fined NOK 92M (about EUR 8.6M); Temu must keep Texans' data on US servers Document where data lives and whether upstream consent is real —
Privacy officers Counts arrive late: CenterPoint's 8-K had none, a Texas listing showed 1,062,060; ETS notices began Oct 16 Plan notification on the first facts, then update the count —
Executives California 2026 CCPA settlements total $17.1M for five cases, 75% from one (GM, $12.75M) One large case dominates the exposure; this is a trade-press estimate —
Executives Japan counted 454 leaks Jan-Sep and 19 cases of 1M+ records by mid-October Treat consumer-data platforms as the exposed front door —
Cross-border teams DPF in force but contested; GSA clause is the only new binding rule; Kenya and Thailand items are guidance or draft Track the DPF; apply the GSA clause only if you are a GSA contractor —
