1. Key takeaways from the month
Between Sep 24 and Oct 23, 2026, the platforms shipped AI at the infrastructure layer, tightened the originality test for creators, raised their ad prices and paid more for their conduct in court. Five conclusions explain the month; each is supported in the chapter named in brackets, with every item judged against Oct 24, 2026.
1. AI shipped as plumbing, while the shopper-facing agents stayed in testing. Meta released Muse Wonder and Wonder Full on Oct 12, and Zuckerberg called them "our first frontier model" on Oct 21. TikTok made its Ad Network generally available in the US on Oct 5, its 48th market, but Buy Direct, Shopping Assistant and Agentic Leads remain in eligibility-based testing with no start dates. On the independent index Wonder Full scores 56 against 58 for Claude Opus 5.5. [Chapter 2]
2. Originality is now the shared test for reach and pay. YouTube's Oct 1 post says channels "primarily" re-uploading others' videos will likely see less Shorts distribution, with no start date or threshold. Instagram has applied a rolling 30-day test since Apr 30, and YouTube's Shorts revenue pool needs 10 million qualified views per 90 days from Feb 1, 2027. Disclosure also widened, as YouTube's GenAI list gained music on Oct 3 and YouTube Music began labelling AI tracks on Oct 14. [Chapter 3]
3. Ad demand is strong, but the risk is moving to the advertiser. Meta reported Q3 revenue of $64.60B, up 26%, and guided Q4 to $73–76B. WARC estimates 2026 social ad spend at $394.6B, up 21.3%. Meta's AI agents inside ad accounts are still in test, while new terms effective Oct 30 make advertisers responsible for AI-generated changes (agency summary). [Chapter 4]
4. Penalties landed on Meta and X, and the rule-making targets minors. A judge set New Mexico's penalty against Meta at $25 billion on Oct 21, and Meta said it would appeal. Meta's own filing records an August agreement with 52 attorneys general worth up to about $18.59 billion and a $9.89 billion Q3 charge. The US Justice Department applied on Sep 24 to join X's appeal of its €120M DSA fine, and the EU's KIDS Act proposal bars accounts under 13. [Chapter 5]
5. For brands the calendar is short and the open items are specific. Marketing API changes land on Oct 27, Meta's terms on Oct 30, and EU KIDS Act feedback closes on Dec 3. YouTube's start date, TikTok's payout floor and appeal outcomes remain unresolved. [Chapter 6]

2. Product updates
Chapter 1 gave the month's headline conclusions; this chapter shows the product changes behind them, platform by platform, separating what shipped from what was only announced (status judged against 2026-10-24). Most of the material here is trade press and tracker blogs, so items read "according to X" unless a company page is quoted.

2.1 Meta: Muse moves from app to models, business tools and paid links
Muse, Meta's personal AI agent, launched in the US on Sep 8 (before the window). According to Gmelius, citing Apptopia and Sensor Tower, it passed five million US downloads in 22 days, against 56 days for ChatGPT. Inside the window, Meta Enterprise Platform was announced on Sep 28 (according to INDmoney), Muse for Small Business was released on Sep 29, and Muse Wonder and Muse Wonder Full followed on Oct 12. Wonder goes to developers through the Meta Model API. Wonder Full is kept for Muse Code subscribers, and paying Muse subscribers get first use in the app. On Oct 21 Mark Zuckerberg called Muse and Wonder "our first frontier model" in Meta's Q3 release (company statement).
The benchmarks disagree. On Meta's own MemoryBench, Wonder scores 85.6 against 81.5 for Claude Opus 5.5, but Opus 5.5 wins nine of the fourteen tests in Meta's table. On the independent Artificial Analysis index, Wonder scores 52, Wonder Full 56 and Opus 5.5 58, so Wonder Full trails by 58 − 56 = 2 points. We follow the independent index. Amazon's block on Muse is dated Sep 20 by Bloomberg (via MBW) and Sep 21 by Gmelius; we follow Sep 20, and either way it predates the window.
On Instagram, links in posts and Reels arrived with Meta One business plans, promoted on Oct 13 (according to InvisibleAPI). Prices are US figures and vary by region. The per-link column is our arithmetic, not a Meta price:
| Meta One plan | Price per profile per month | Links per month (posts + Reels) | Price per link |
|---|---|---|---|
| Essential | $14.99 | 0 | n/a |
| Advanced | $49.99 | 4 + 4 = 8 | 49.99 ÷ 8 = $6.25 |
| Expert | $149 | 8 + 8 = 16 | 149 ÷ 16 = $9.31 |
| Max | $499 | 12 + 12 = 24 | 499 ÷ 24 = $20.79 |
Source: InvisibleAPI. Each tier's other benefits (seats, support) are bundled, so the per-link price overstates the cost of links alone. The same tracker lists an AI assistant in Edits (Sep 30, launched) and an Oct 5 test of opening the app on Reels.
For teens, Kroha reports that supervising parents see the topics a teen asked Meta AI about over the past seven days, not the chats, and can switch a teen to a "Limited Content" setting; it says supervision is available in the Meta AI app globally as of October 2026. HeyOtto adds that WhatsApp added parental controls in September 2026. Meta's own announcement is not in the material, so treat this as reported. Zuckerberg said Threads has passed X in monthly active users (via MarketBeat).
2.2 TikTok: ad network opens in the US, shopper agents stay in testing
Meta shipped an agent to consumers; TikTok shipped the plumbing for agents and kept its shopper-facing tools in testing.
At Advertising Week New York on Oct 5, TikTok made TikTok Ad Network (TTAN, formerly Pangle) generally available for US campaigns, its 48th market. TikTok says it reaches nearly 400,000 apps and over 1 billion daily active users worldwide, with 95 million incremental US users based on US-only internal measurement. It runs inside TikTok Ads Manager, with Integral Ad Science providing independent measurement. t3n says "more than 400,000" apps; we follow TikTok's "nearly 400,000". This follows the TikTok USDS Joint Venture LLC, completed on Jan 22, 2026 (context): Oracle, Silver Lake and MGX hold 15% each and ByteDance 19.9%. The shopper-facing agents are not yet shipping. Buy Direct (in-app checkout, including one click from the For You feed), Shopping Assistant and Agentic Leads are available through "eligibility-based testing", built with Salesforce, Shopify, Shoplazza and Stripe. PPC Land finds no start date, market list or merchant fee terms; t3n says Buy Direct starts in the US first. The tool that has shipped is the TikTok for Business Model Context Protocol, introduced in May. It is now a connector on Claude, Kimi, Manus, Perplexity, Replit, Snowflake and Tencent WorkBuddy, and advertiser use grew more than 200% in July to September (TikTok internal data, no base figure). Smart+ for search ads and GMV Max were announced alongside it as ad products.
2.3 YouTube, X and the smaller platforms
YouTube. "Shorts series" (seasons and episodes across web, mobile and TV, for Partner Program creators) was announced at Made On YouTube on a Wednesday; MediaPost's Sep 24 dateline implies Sep 23, one day before the window. YouTube says microdramas passed 6.5 billion views in H1 2026. SocialBee lists undated October items: a Shorts "Conversational Editing" test, iOS ad filters and a desktop layout test. The Shorts bonus pilot (Oct 15) is covered in Chapter 3.
Net Influencer data (via Parasocial Magazine, Oct 14) shows where live audiences went in Q3 2026:
| Platform | Hours watched (Q3 2026) | Share of 31.7B total |
|---|---|---|
| YouTube | 13.62B (−13.7%) | 43% |
| TikTok LIVE | 10.6B (+19%) | 33.5% |
| Twitch | 4.51B (+4%) | 14.2% (4.51 ÷ 31.7) |
| Kick | 2.04B (+30.7%) | 6.4% |
X and Grok. On Oct 2, Elon Musk posted "Ask @Grok in XChat"; the material has no release note, so this is a company-owner post, not a documented rollout. On Oct 12, xAI launched The X Subscription, one plan for Grok, Grok Bot, Cursor and X benefits. SocialBee called the tiers "XPass" while they were in development; we follow the launched names:
| Plan | Monthly | Annual | Annual ÷ 12 | Saving vs monthly |
|---|---|---|---|---|
| Plus | $8 | $80 | $6.67 | 16.7% |
| Premium | $30 | $300 | $25.00 | 16.7% |
| Super | $100 | $1,000 | $83.33 | 16.7% |
| Ultra | $200 | $2,000 | $166.67 | 16.7% |
Source: ShareAllAI, quoting official pricing documentation. The saving is 1 − 300 ÷ (30 × 12) = 16.7%, equal to two free months. Existing SuperGrok subscribers can keep their plans, migration has no timetable, and unifying accounts is permanent. Bluesky. SocialBee reports October options to keep posts out of algorithmic recommendations and to hide accounts from logged-out users and a test of up to 10 bio links; no day is given and no Bluesky page is in the material. Reddit is expanding Max campaigns to lead generation (Oct 6; reported, see Chapter 4).
Gap: the material has no Snapchat or Pinterest product news and no Threads feature list for October (the Threads tracker returned only navigation text).
3. Creator and algorithm policies
Chapter 2 listed what the platforms shipped. This chapter covers the rules that decide who gets distribution and who gets paid. Every item is judged against 2026-10-24, and items dated before Sep 24 are context only.
3.1 Policy changes at a glance
| Item | Key figure | Date | Status | Source |
|---|---|---|---|---|
| YouTube Shorts originality (recommendations) | Channels "primarily" re-uploading others' videos get less Shorts distribution; no threshold | Oct 1, 2026 | Announced; start date not stated | YouTube Help post (via OutlierKit) |
| YouTube GenAI disclosure adds music | 4th disclosure item: music that is "the main focus of the video" | First seen Oct 3, 2026 | In effect on the help page (reported) | AuditSocials |
| YouTube Music AI labels | Label on the player page; to expand to the main YouTube app | Oct 14, 2026 | Rolling out; regions not stated | YouTube Blog |
| YouTube Shorts bonus | Invite-only; YPP channels in 6 countries | Oct 15, 2026 | Pilot | Upstream (via Creator Insider) |
| X Video Kickstart Bonus | 15 qualifying videos on 15 days | Oct 15, 2026 | Invite-only pilot | Upstream; shortshort |
| Facebook AI feed control | Users steer the feed "in plain language" | October 2026, day not stated | Announced ("will soon") | SocialBee |
| YouTube Shorts Creator Pool | 10 million qualified Shorts views per 90 days | Announced Aug 10; effective Feb 1, 2027 | Announced (context) | OutlierKit |
| Instagram unoriginal-account rule | Rolling 30-day test, photos, carousels, reels | Apr 30, 2026 | In effect (context) | shortshort |
3.2 YouTube: originality, AI music and likeness
Originality. On Oct 1, 2026, JJ of TeamYouTube posted "Prioritizing original content on Shorts" in the YouTube Help Community. The recommendation systems will "further prioritize original content and reduce the reach of content re-uploaded from other creators without adding anything of your own". Channels "primarily aggregating or re-uploading other creators' videos without significant changes will likely see less distribution within the Shorts feed". The test applies to the channel, not to a single upload. In a Creator Insider video the same day, Creator Liaison Rene Ritchie said voice-over that only describes the screen, minor technical edits and template-based bulk changes are not enough. He also said reach is re-evaluated if a channel shifts to original work.
Status: announced. YouTube gave no start date, no threshold for "primarily", no notice to affected channels and no status screen. It did not address Shorts cut from a creator's own long videos, which OutlierKit and Relevant Audience read as not targeted (their inference). Monetisation is unchanged, but the reused-content policy already applies to the whole channel and "is not based on copyright, permission, or fair use". Built by Foundry concludes from this that paid clipping campaigns, where independent editors post cuts of a creator's videos on their own accounts, get no protection from a licence. That is the outlet's reading, and YouTube announced no separate clipping rule.
The revenue test follows soon. From Feb 1, 2027, a channel needs 10 million qualified Shorts views in the trailing 90 days to share Shorts ad revenue (announced Aug 10, 2026). That is 10,000,000 ÷ 90 ≈ 111,000 views a day, and the date is 100 days after the run date. Less feed reach lowers that count.
AI music. AuditSocials captured YouTube's "Disclosing use of GenAI content" page on Oct 2 and Oct 3. The list of must-disclose content grew from three items to four, adding "creates music that's the main focus of the video"; "AI generated music" was already an example on Oct 2. YouTube has not defined "main focus" or announced the edit. Creators answer "AI use" under Attributes in YouTube Studio. Disclosure "won't limit a video's audience or impact its eligibility to earn money", but creators who consistently skip it risk labels, removal or YPP suspension. Own-voice cloning for dubs and audio repair need no disclosure. On Oct 14, 2026 YouTube said YouTube Music starts labelling tracks "created primarily using generative AI", for example composition and vocals. The labels will expand to the main app and rely on music partners and YouTube's own detection.
Likeness (context). Likeness Detection has been open to channel owners and managers aged 18 or over since May 17, 2026. It matches faces only, on YouTube only, and removal still goes through YouTube's review. AIR Media-Tech says the NO FAKES Act cleared the Senate Judiciary Committee on June 18, 2026 and had not moved by Sep 26. The material shows no in-window step.
3.3 Meta, TikTok and X: the same test, different disclosure
Instagram has applied the originality test since Apr 30, 2026 (context). Accounts that mostly post unoriginal photos, carousels or reels are not recommended to non-followers, using a rolling 30-day window and an Account Status screen. Facebook defined "original" on Mar 13, 2026, and mostly-unoriginal accounts can become non-recommendable and demonetised. On Mar 18 it announced Creator Fast Track at $1,000 a month (100,000+ followers elsewhere) or $3,000 (1 million+) for three months, i.e. $3,000 or $9,000 in total. In the window, Facebook announced an AI-assisted algorithm control; SocialBee gives no day or region.
| Instagram route (Meta help pages, as of Oct 7, 2026) | Followers required |
|---|---|
| Gifts | 500 |
| Creator Marketplace | 1,000 |
| Affiliate partnerships | more than 1,000 |
| Badges in Live; Subscriptions | 10,000 each |
| Bonuses | none published, invite-only |
Source: Blotato.
TikTok. No Creator Rewards or recommendation change dated in the window turned up. Per TikTok help pages read on Oct 3, Creator Rewards needs a personal account, age 18+, 10,000 followers and 100,000 views in 30 days, in eight regions (US, UK, Germany, France, Japan, South Korea, Brazil, Mexico). Only original videos over one minute earn, after 1,000 qualified For You views, and RPM is unpublished. Sources conflict on the payout floor: the Help Center says $10, the EEA terms say $50, and US terms quoted by Payouts.com also say $50. We treat the floor as unresolved and defer to the creator's Balance screen. Claims that comments now outweigh likes, or that videos are tested on followers first, come from agency blogs and not from TikTok.
Bonus pilots. Both pay for original output. YouTube's Shorts bonus (Oct 15) invites YPP channels in the US, UK, Germany, Brazil, Japan and South Korea, with a minimum payment plus a possible bonus on organic engaged Shorts views. X's Video Kickstart Bonus pays invited creators for 15 qualifying videos on 15 different days in about a month. A video must be 9:16, under three minutes and the creator's own, with no other platform's watermark. Neither source states payment amounts.
3.4 Judgement: what changes for creators
Reach on Shorts, Reels and Facebook now depends on the same originality test that already governed pay. YouTube's Oct 1 change adds no window and no status screen, unlike Instagram.
Instagram shows a 30-day window and a status screen; YouTube shows neither. YouTube creators therefore have to find a reach drop in Studio themselves. Channels built on reposts, and clipping agencies paid per 1,000 views, carry the most risk. Creators who add commentary or storytelling, or post their own footage, are not targeted. Brand teams should audit the last 30 days of posts for how much is original. They should also tell any creator using AI music to set "AI use" in YouTube Studio. The next fixed date is Feb 1, 2027. Unresolved are YouTube's start date, TikTok's payout floor and the NO FAKES vote.
4. Advertising and monetisation
Chapter 3 covered how creators are paid and ranked; this chapter follows the advertiser's money, from Meta's Q3 results to TikTok's ad network and the 2026 spend forecasts.
4.1 Advertising and monetisation at a glance
| Item | Key figure | Date | Status | Source |
|---|---|---|---|---|
| Meta Q3 2026 revenue | $64.60B, +26% | Oct 21 | Reported | Meta IR |
| Meta Q4 revenue guide | $73–76B | Oct 21 | Guidance | Meta IR |
| Meta Advantage+ video from static assets | All advertisers | Oct 6 | GA | Meta (via Relevant Audience) |
| Meta assistant agentic actions | 5% more conversions (claim) | Oct 6 | In test | Meta (via Relevant Audience) |
| Meta ad terms | AI-content liability | Oct 8; effective Oct 30 | Announced | Common Thread Collective |
| TikTok Ad Network | US; nearly 400,000 apps | Oct 5 | GA (US) | TikTok (via MBW) |
| TikTok Shop GMV, H1 2026 | $50.3B global | Sep 26 | Estimate | Momentum Works (via SmartScout) |
| WARC global ad spend 2026 | $1.34T; social $394.6B | Oct 8 | Estimate | WARC (via The Desk) |
Ad demand is strong: Meta grew 26% and WARC lifts social to $394.6B. But the AI tools that act inside advertiser accounts are still tests, while the terms making advertisers liable for AI output start on Oct 30.
4.2 Meta: results beat guidance, and the ads stack turns agentic
Meta reported Q3 revenue of $64.60B on Oct 21, up 26% from $51.24B. Its July guide was $61–64B and the LSEG consensus was $63.42B (via INDmoney). That is a beat of 64.60 − 63.42 = $1.18B (1.9%). Ad impressions rose 10% and price per ad 14%; 1.10 × 1.14 = 1.254, about +25%, which fits advertising revenue of $63.1B, up 26% (MarketBeat).
The engine is expensive. Costs rose 68%, including a $9.89B charge for the attorneys-general agreement (see Chapter 5). Excluding it, operating income would be 12.99 + 9.89 = $22.88B, a 35% margin against 40% a year earlier. Free cash flow was −$2.12B on $34.91B of capex, and 2026 capex guidance is $135–145B. Management said it expects future AI revenue from commerce fees, subscriptions, APIs and business services (commentary). Muse for Small Business was released on Sep 29 (product detail in Chapter 2).
The Oct 6 Advertising Week tools differ in status:
- Live: Customer Lifecycle Strategy for all advertisers; video from static assets in Advantage+ creative (GA).
- Rolling out or beta: Ads Creative Studio beyond launch partners; Catalog Product Video.
- In test: agentic campaign, targeting and budget changes; scheduled alerts; direct checkout in Meta AI.
- Not yet: AI audience discovery in Detailed Targeting, promised "by the end of the year".
The 5% figure is Meta's own, with no method or period published. According to Common Thread Collective, terms announced Oct 8 and effective Oct 30 make advertisers responsible for AI-generated changes, even those Meta's tools make, and let Meta run tests and crawl advertiser sites for AI development. That is an agency summary, not Meta's text. Dated API changes, per GoodMorning: Marketing API v24.0 ended Oct 6 (done), WhatsApp Embedded Signup v2/v3 was deprecated Oct 15 (in effect), and messenger_positions story removal is scheduled for Oct 27. The click-to-WhatsApp free window grew to 7 days on Sep 28 (Aurelius Media).
4.3 TikTok, X and the smaller networks
TikTok Ad Network. On Oct 5 TikTok made TTAN (formerly Pangle) generally available for US campaigns, its 48th market. TikTok says it reaches nearly 400,000 apps worldwide; t3n says "more than 400,000", and we follow TikTok. Half of TTAN's users are off TikTok, a US incremental audience of 95 million (internal measurement). The 65% better cost per acquisition comes from an April 2024 internal test in Pangle markets, so treat it as a vendor claim. Buy Direct and Agentic Leads have no start dates.
TikTok Shop. No TikTok-published GMV figure appears in the material. Momentum Works (via SmartScout, Sep 26) estimates H1 2026 GMV at $50.3B (+92%), US $11.8B (+103%). Full-year estimates conflict: $123.5B (64.3 × 1.92, SmartScout) versus $112.2B (Ringly, Oct 2). We use $112–124B as the range. eMarketer's TikTok US ad revenue estimate is $13.7B (+37%), implying 13.7 ÷ 1.37 ≈ $10.0B in 2025 (via Amra and Elma).
X and Threads. Per The Telegraph (Sep 25), via tech-insider.org, X's UK unit had 2025 revenue of £46.4M (+61% on £28.8M), but UK advertising was flat at £22.9M while services billed to its parent rose to £23.6M. Agencies call X a "selective" buy. X launched lead-generation ads globally (date not stated). Early data show Threads CPMs 30–40% below Instagram Feed.
Reddit, Pinterest, Snap. Reddit's Q2 ad revenue was $762M (+64%); its Q3 guide of $860–870M implies about 48% growth, or 865 ÷ 1.48 ≈ $584M a year earlier. Max campaigns reached lead generation on Oct 6. As of Oct 5, Zacks has Reddit −35.7% year to date, Snap −30.9%, Pinterest −25.6% and Meta +10.3%. Q3 dates for Snap, Pinterest and Reddit are not in the material.
4.4 The spend outlook: more money, fewer hands
WARC's Q3 update (Oct 8, estimate) has global ad spend up 11.9% to $1.34T, with social the fastest channel at $394.6B (+21.3%), so 2025 was about 394.6 ÷ 1.213 ≈ $325B. Alphabet, Amazon and Meta take 59.7% of spend outside China ($659.6B), and WARC expects growth to slow to 8.4% in 2027.
Forecasts disagree on definitions: Madison and Wall says $1.42T and dentsu $1.06T, a $360B spread. IAB raised its US 2026 growth call to 12.3% from 9.5% on Sep 10 (context, before the window; via an aggregator). We follow WARC globally because it is the only in-window update. For marketers, budgets are flowing to platforms with closed-loop measurement, and those platforms now ask advertisers to accept AI liability.
5. Regulation and litigation
Chapter 4 covered what the platforms earn; this chapter covers what courts and regulators are taking back, and the pattern is clear: the money penalties land on Meta and X, while the rule-making is aimed at minors' access to every platform. Items before Sep 24, 2026 are context only.
| Item | Key figure | Date | Status | Source |

5.1 Meta: one appeal, one settlement, one new penalty
FTC appeal. The FTC is asking the D.C. Circuit to revive its monopolisation case over Instagram and WhatsApp. Chief Judge James Boasberg dismissed it on Nov 18, 2025, finding that YouTube and TikTok belong in the market. In a brief filed the week before Oct 6, the FTC said that analysis was "irredeemably flawed", and that the FTC Act "says nothing about the time of decision". Meta's August filing countered that friends' content is under 15% of Facebook feed posts and 5% of Instagram's. Docket number and hearing date are not stated; this is briefing, not a ruling.
State settlement. Meta's own filing is the primary source. In August 2026 it agreed with 52 attorneys general to resolve teen mental-health litigation, with payments of up to about $18.59 billion, and booked a $9.89 billion charge in Q3, which cut diluted EPS from $7.40 to $3.83. The charge is 9.89 ÷ 18.59 ≈ 53% of the headline figure, so most of the cost is spread over later periods. Press counts of states conflict: 29, 48 or 51. We follow Meta's 52, which matches the reported split of 47 states, DC and three territories at up to $17.1 billion plus a separate Texas deal of more than $1 billion. The gap 18.59 − 17.1 = $1.49B is our inference, not a stated Texas figure. Reported terms include a two-hour default teen limit with parental override. Florida did not sign, and the personal-injury claims are preserved.
New Mexico. This is a litigated outcome, not a settlement. A Santa Fe jury found in September that Meta misled users on privacy and committed over 43 million violations of the unfair practices act, each carrying up to $5,000. On Oct 21, 2026 Judge Francis J. Matthew set the penalty at $25 billion, reduced from $219.5 billion. The arithmetic works: $219.5B ÷ $5,000 ≈ 43.9 million violations, and $25B is about 11% of that ceiling. The state had sought $35–40B and Meta argued for no more than $3.4B. Meta said it would appeal and interest accrues meanwhile. The same state earlier won a $375 million jury verdict, then a $567 million abatement order, in a child-safety case that Meta also said it would appeal. Meta's filing warns of "a number of youth-related trials scheduled in the coming months in the U.S.".
Meta's exposure has moved from the FTC's market theory, which is stalled on appeal, to state consumer-protection and child-safety law, where it has now produced both a settlement and a $25 billion judgment.
5.2 X: the first DSA fine goes to court
On Dec 5, 2025 the European Commission fined X €120 million, the first non-compliance decision under the Digital Services Act, for a deceptive paid blue check (Art. 25(1)), an incomplete ad repository (Art. 39) and blocked researcher access (Art. 40(12)). No breakdown by breach was published. X appealed to the EU General Court in February 2026. On Sep 24, 2026 the US Department of Justice applied to intervene on X's side, arguing the Commission "inappropriately attempted to expand its regulatory authority". On Sep 25 the Commission said it was "ready to defend" the fine. No hearing date appears in the material.
Two facts cut against escalation. The Commission accepted X's remediation plan in July 2026, subject to an independent audit, and X now labels EU subscribers "premium", not "verified". Whether the €120M has been paid is not stated. DSA fines can reach 6% of global turnover, so €120M is a signal, not a ceiling.
5.3 Minors' age rules and the private docket
The blueprint's "under-16 ban" framing does not fit the EU proposal. The Commission's KIDS Act, proposed Sep 17, 2026, bars accounts under 13, allows guardian-run accounts at 13–14 with a one-hour daily cap, and allows independent accounts from 15 on services meeting safety-by-design rules. It requires certified age verification, bans autoplay and infinite scroll for minors, and carries fines up to 6% of turnover. Feedback is open until Dec 3, 2026. It still needs Parliament and Council approval, and Paul Hastings thinks adoption is unlikely before 2028. Other regimes: Australia's under-16 ban, in force since December 2025; a UK under-16 ban announced in June 2026 for spring 2027; and Denmark's draft age-15 bill. The material contains nothing on the Philippines.
In private litigation, plaintiff-firm sites report 3,824 pending claims in MDL-3047 before Judge Yvonne Gonzalez Rogers, against 3,137 in August. That is (3,824 − 3,137) ÷ 3,137 ≈ 22% growth, but the two counts come from different firms and are an estimate. One of them says TikTok was settling three California cases set for October, while Meta, YouTube and Snap remained defendants. Outcomes are not in the material.
6. Impact on brands
Chapters 2 to 5 covered products, creator rules, money and law. This chapter turns them into what brands, agencies and creators should do, using only facts already stated there, with status judged against Oct 24, 2026.
6.1 What changed and what it means, by reader
| Reader | What changed | Implication | Evidence |
|---|---|---|---|
| Meta advertisers | Q3 impressions rose 10% and price per ad 14%; agentic campaign changes are in test; terms effective Oct 30 make advertisers responsible for AI-generated changes | Pay more per ad, so audit Advantage+ campaigns before Oct 30 and keep human review of AI output; treat the 5% conversion gain as a vendor claim | — |
| TikTok advertisers | Ad Network is GA in the US (nearly 400,000 apps); Buy Direct and Agentic Leads have no start dates | Test the network with independent measurement and do not budget for shopper agents yet; reach and CPA figures are company claims | — |
| Media planners | WARC puts 2026 spend at $1.34T (+11.9%), social at $394.6B; other forecasts span $1.06T to $1.42T | Plan on a range, not a point; money is flowing to platforms with closed-loop measurement | — |
| Agencies running clipping or repost programmes | YouTube will likely reduce Shorts reach of channels "primarily" re-uploading others' videos; the reused-content policy is "not based on copyright, permission, or fair use" | Require added original work in briefs and contracts; a licence alone does not protect reach (outlet's reading) | — |
| Commerce and shop teams | TikTok Shop 2026 GMV estimates conflict: $123.5B against $112.2B | Use the $112–124B range and wait for a company figure | — |
| Creators | Shorts revenue pool needs 10 million qualified views per 90 days from Feb 1, 2027; GenAI disclosure now lists music; bonus pilots are invite-only | Check Studio reach, set "AI use" for AI music, and treat the pilots as unconfirmed income | — |
| Legal and brand-safety teams | New Mexico $25B judgment, a 52-attorney-general agreement, X's €120M DSA fine under appeal, and the EU KIDS Act proposal | Expect tighter age and safety rules around teen reach; none of these is final | — |
Money is moving to the platforms that can measure the whole loop, but the risk is moving to the advertiser: Meta's AI tools stay tests while its terms make advertisers answerable for AI output from Oct 30, and courts are pricing platform conduct in the billions.
6.2 Reading across the platforms
Budget follows measurement. Meta grew revenue 26% to $64.60B and guided Q4 to $73–76B, while WARC expects social to grow fastest at 21.3%. Alphabet, Amazon and Meta take 59.7% of spend outside China. X is the contrast, with UK advertising flat at £22.9M and agencies calling it a "selective" buy.
AI liability is the practical change. The tools that act inside ad accounts are in test, and the 5% conversion gain has no published method. The terms still start on Oct 30 and, per Common Thread Collective, let Meta run tests and crawl advertiser sites. That is an agency summary, not Meta's text.
Originality decides reach. Instagram has run a 30-day test since Apr 30, and YouTube shows no window or status screen, so brand teams should audit the last 30 days of posts for how much is original. Ask creators using AI music to set the disclosure.
Legal risk is rising but unsettled. The 52-attorney-general agreement is worth up to about $18.59B, and Meta booked $9.89B in Q3. The $25B New Mexico penalty is under appeal, and the DSA fine on X is contested at the General Court. The KIDS Act would need Parliament and Council approval.
Open items. The material has no Q3 dates for Snap, Pinterest or Reddit, no YouTube start date for the originality change, and no resolution of TikTok's $10 against $50 payout floor.
