1. Key takeaways from the quarter
Between Jul 25 and Oct 23, 2026, brain-computer interfaces (BCIs) advanced through demonstrations, financing and rules about conditions of use, while no implanted device gained new market access. Five conclusions explain the quarter; each points to the chapter that holds the evidence, with status judged against Oct 24, 2026.
1. Speech moved into human use, but the evidence is single-participant and company-reported. On Sep 14, Paradromics said its first Connect-One participant had a free sentence decoded in real time "with no errors", one sentence with no published error rate. Neuralink posted a video on Sep 16 of the third VOICE participant (NCT07224256) speaking with a synthesised voice, and no peer-reviewed accuracy or latency benchmark exists. Its latest stated count is 21 PRIME participants with zero serious device-related adverse events, reported Jan 28, 2026. Synchron has the best-documented safety record, with four SWITCH participants completing 12 months without a serious adverse event, but that paper dates from 2023. [Chapter 2] [Chapter 4]
2. Regulators changed the conditions of use, not market access. The FDA letter of Aug 26 lets Paradromics add compatible laptops, tablets and phones to its investigational system without per-device approval. CorTec reports a second Breakthrough Device Designation, granted in August, and a designation is not an approval. In China, Neuracle's NEO sold 13 units at 475,000 yuan, 13 × 475,000 = 6.175 million yuan, and sits in no insurance catalogue. CMS comments on a Neuralink coding request closed on Oct 16. The FDA says a designation still requires the same safety and effectiveness standards as any other device. [Chapter 3]
3. Durability and scale claims are real but not comparable. Paradromics reported stable recording for more than four years in two sheep, plotted at days 1,470 and 1,443. CorTec reported 63 of 64 contacts working in macaques, with data to day 1,361 (3.7 years, 1,361 ÷ 365.25); one contact failed at about 14 months. Precision's preprint atlas covers 70 patients and over 180 hours. Paradromics tested pure tones in auditory cortex, CorTec a visual-motor task, and Precision's device is cleared only for temporary use. Different species, tasks and criteria mean none of these can be ranked against another. Neuralink also reported over 50,000 hours of human recordings on Oct 1, and Synchron's 16-electrode Stentrode has so far yielded clicks and menu selection. [Chapter 4]
4. Money followed the field, and trackers disagree on its size. Precision announced a $250M Series D on Sep 24, bringing total capital to $430M. One tracker counts 72 BCI financings since January 2024, 44 of them Chinese and 18 American, yet the US took 63.4% of capital. Four trackers range from $1.63B to $4.95B because they count different things. Neuracle's RMB 2.5bn STAR Market application is pending, against 6.175 million yuan of cumulative NEO sales. Gestala's two rounds total RMB 570M, about $84M. [Chapter 5]
5. Rules are moving on data, while implant safety evidence stays thin. A Communications Medicine review published Jul 27 names five gaps in implantable-BCI data protection. The US MIND Act, a proposed FTC study of neural data, was still awaiting committee action on Oct 16. The only implant safety count in the material is the developer's own. The Australian Human Rights Commission found that 24 of 30 consumer neurotechnology companies had policies allowing potential sale of neural data. [Chapter 6]

2.2 Intracortical speech: Neuralink and Paradromics
Both companies moved speech restoration into human use, but they reported different things.
Neuralink. The latest company-stated count is 21 participants on Jan 28, 2026. A Neura Pod tally of 27+ in October is a third-party count, not Neuralink's. New Market Pitch (Sep 8) puts the count seven months earlier at five, a jump of 21 − 5 = 16. Neuralink also reported more than 50,000 hours of human neural recordings in an Oct 1, 2026 update.
VOICE is the newer study. Neuralink posted a 23-second video on Sep 16, 2026. Neuralink's later full video identified the participant as Terry, the third VOICE participant, who has bulbar-onset ALS and can still move. A second participant was shown in March. According to Yahoo Tech, Neuralink has published no peer-reviewed accuracy or latency benchmark for VOICE. explainx dates the post Sep 17; we follow the Sep 16 timestamp.
Paradromics. The first Connexus implant was placed in June 2026 at the University of Michigan. Meticulous Research dates it June 17. On Sep 14, 2026 the company said its Michigan participant, a woman in her 60s with motor neuron disease, chose her own words, answered open-ended questions and held a phone call. The company says her first free sentence, "Okay, I have a lot to say", was decoded in real time with no errors. That is one sentence, with no published error rate. The study runs under an IDE granted in November 2025 and has three sites: UC Davis, Mass General Brigham and Michigan. One participant out of up to 10 means 10% of planned enrolment (1 ÷ 10).
The two headline speech results are company demonstrations on single participants, one in the VOICE study and one in the Connect-One feasibility study, with no peer-reviewed accuracy figure for either.
2.3 Endovascular, surface and Chinese programmes
Synchron has the best-documented safety record but the smallest recent news flow. Registered participants add up to 10 + 6 + 5 = 21 across INTENT, COMMAND and SWITCH, matching the Briefing's total. SWITCH is the only peer-reviewed set: four implanted participants completed 12 months with no serious adverse event, vessel occlusion or device migration. The registry lists five SWITCH participants against four in the paper; the material does not explain the gap. A pivotal trial is described as planned for 2026 (reported, not a company filing in this material). One source speaks of "100-patient cohorts" at Synchron, which the registry data do not support; we follow the registry.
Precision counts procedures, not chronic users. The company reports more than 100 procedures at 18 institutions. Its website claimed more than 95 clinical-study patients on Sep 8. Many are temporary placements during neurosurgery already needed, and the clearance allows up to 30 days. A preprint reports 70 patients at 12 centres, over 180 hours of recordings and finger representations resolved at 0.8 mm. It is a preprint with company-collected data.
Blackrock Neurotech reported no sponsor milestone in the material. Its Utah Array, first placed in a human in 2004, underlies most BCI trials to date. The BrainGate consortium listed a Current Biology paper online on Aug 11, 2026 (array maker not stated).
China. ClinicalTrials.gov lists 21 open studies with a Chinese site, 11 of them implanted, as of Oct 19, 2026. That register under-counts studies outside the United States. StairMed has four registered studies, including WISE and a spinal-cord-injury study (NCT07603752, Apr 28, 2026), both at Huashan Hospital. Neuracle's NEO study (NCT06990412) is marked completed; its approval is in Chapter 3. NeuCyber's Beinao implants appear only as a programme, with no identifier or participant count.
Outcome measures do not line up. Neuralink cites bits per second on cursor tasks (a record of 11.32 in 2026, company-reported; why it cannot be compared with speech figures is in Chapter 4). Paradromics cites error-free decoding of one free sentence. Synchron's 16-electrode device has yielded clicks and menu selection. None of these can be ranked against another.
Others. CorTec's first stroke participant had the system removed after nine months, as the protocol planned. Bridge Neurotech opened a first non-invasive ultrasound study on Oct 6, 2026, without a published identifier.
3. Regulatory approvals
Chapter 2 followed the trials from first implants toward wider use; this chapter lists what regulators decided, proposed or put into force between Jul 25 and Oct 23, 2026. The material shows no new marketing authorisation for an implanted BCI in the window. Regulators moved on conditions of use instead: what an investigational system may connect to, how brain data must be prepared, and how a BCI procedure is coded.

3.1 United States: investigational-stage decisions
Paradromics announced on Aug 26, 2026 that the FDA had issued an approval letter expanding the computing devices usable with its investigational Connexus BCI. Once an agreed deployment and testing process is followed, compatible laptops, tablets and phones can be added to its Convey software "without requiring Paradromics to seek approval for each new device". The instrument is a change to an investigational study, not a market authorisation. The FDA-approved Connect-One Early Feasibility Study (NCT07357428) enrols ages 22 to 75 at three US sites, and the company says the expansion does not change its clinical care model. The FDA granted the underlying IDE in November 2025 (context). We follow the company release; the trade reports repeat its wording and no FDA document is in the material.
CorTec, a Freiburg company with a non-penetrating surface-electrode implant, received its second Breakthrough Device Designation, this time for cursor control by people with non-progressive quadriplegia. The first (April 2026, stroke rehabilitation) is context. The two sources disagree on timing. CorTec's Oct 21 release says August, while the trade report is dated Sep 18. We follow the company's month and treat the exact date as not stated. CorTec also reports entry into the FDA Total Product Life Cycle Advisory Program (TAP) in 2026 (month not stated) for its stroke programme. Its University of Washington stroke study (NCT06506279) has three implanted patients (company-reported).
A designation is not an approval. The FDA says the programme speeds development and review, gives prioritised interaction, and still requires the same safety and effectiveness standards; a decision on a request comes within 60 calendar days. Neurotech Reports adds that the FDA has no BCI-specific pathway, and that the best-case US timeline averages just over 300 days, "nearly double" China's fast track (reported). That implies roughly 150 to 160 days for China, our inference, not a published figure. Context: Precision Neuroscience's Layer 7 has FDA clearance for up to 30 days of use (March 2025), and further FDA review is pending. According to Exoswan, the FDA said in August 2026 that NeuroPace's NAUTILUS submission for its RNS System was "not approvable in its current form".
3.2 China: from registration to purchase list, then data rules
China's NMPA gave Class III registration to Neuracle's NEO hand-function system on Mar 13, 2026 (context, before the window) for adults aged 18 to 60 with C2 to C6 spinal cord injury. Dated reporting shows the pricing sequence: a national insurance consumable code by Mar 22, a Shanghai catalogue entry on Mar 23 and procurement listing on Mar 24, 11 days after registration. Neurotech Reports and TechTimes instead say the code came within 48 hours. We follow the dated BioSpectrum sequence. NHSA's guided price of CNY 6,000 to 6,600 per implantation procedure (April 2026, context) is a procedure price, not a device price (according to Meticulous Research).
A code is not coverage. Per the updated STAR Market prospectus filed Sep 29, NEO's first commercial sale came in July 2026, with 13 units sold, 8 implanted and over 70 intended orders; at the 475,000 yuan list price, 13 × 475,000 = 6.175 million yuan. NEO is in neither the national nor local basic insurance catalogues. Shanghai's Huhuibao supplementary scheme pays 30% of list price up to 150,000 yuan a year, so 0.30 × 475,000 = 142,500 yuan, just under the cap and before surgery and rehabilitation costs. The NMPA also issued, in September 2026, a standard on EEG datasets used by AI in BCI devices, covering collection, processing, labelling, storage and access. TechTimes says it was issued on a Monday and takes effect Sep 1, 2027 (announced); Neurofounders confirms September 2027. Around it, a national BCI reference architecture took effect Aug 1, 2026, and in August the MIIT published a draft roadmap of more than 40 BCI standards by 2028 and more than 80 by 2030 (draft). Chapter 6 covers data protection.
3.3 Reimbursement, Europe and other regulators
In the US the reimbursement signal is procedural. CMS lists a Neuralink request for an ICD-10-PCS code, "Insertion of Brain Computer Interface Device", for an Apr 1, 2027 start, with the requestor intending to file for a New Technology Add-on Payment (NTAP) later. The comment deadline of Oct 16, 2026 has passed. A code request does not create coverage. The RAPID pathway, meant to align FDA authorisation with Medicare coverage for breakthrough devices, is described by Neurotech Reports as announced jointly by CMS and FDA, but by AdvaMed as "proposed", with industry comments pending. We follow AdvaMed's "proposed". No RAPID date or BCI-specific coverage decision is in the material.
In Europe, medical BCIs fall under the Medical Device Regulation. The only EU authorisation in the material is Science Corporation's PRIMA retinal implant, CE-marked and launched on Jul 22, 2026, three days before the window (context). According to Neurapod, the UK MHRA approved Neuralink's GB-PRIME trial, and a startup blog says Canada allowed six participants; dates are not stated for either. The material has no Japan or Korea BCI decision.
The window's regulatory news was about conditions: one FDA letter widening what a trial device may connect to, one extra Breakthrough designation, and China's data standard due Sep 1, 2027. No implanted BCI gained new market access.
For patients, Chinese access exists but is largely self-paid. For developers, the US gates remain designation, IDE and later review. For payers, coding requests precede any coverage rule.
4. Technical routes compared
Chapter 3 covered which regulators moved; this chapter asks what the devices themselves measured in the window, who measured it, and which numbers can sit side by side.
4.1 Route scorecard

| EEG imagined-speech baseline | 49.03 ± 4.18% cross-subject, coarse classification | Week of Sep 21, 2026 | Preprint | Neural Noise |
No route has a decoding number this quarter that is both peer-reviewed and comparable across devices. The one peer-reviewed durability result (CorTec, monkeys) and the loudest one (Paradromics, sheep) measure different things.
4.2 Implants: durability is the contested metric
Paradromics announced on Oct 8, 2026 that cortical modules representative of Connexus recorded stably for more than four years in two sheep, with no electrode migration. The data points shown are day 1,470 and day 1,443 after implantation. Converting: 1,470 ÷ 365.25 = 4.0 years and 1,443 ÷ 365.25 = 3.95 years, so the "more than four years" headline rests on ongoing follow-up beyond the plotted days. The test was pure tones in auditory cortex, with electrodes 40 µm wide reaching 1.5 mm deep. Paradromics also says its spike SNR (above 5) matches or beats published Utah array values of 1.5 to 4 in macaque motor cortex. That compares species, cortex and analysis, so we do not use it. A second study of the full device in six sheep logged over 6,100 active hours in 26 weeks, about 6,100 ÷ 6 ≈ 1,017 h per animal, roughly 23% of the 4,368 h in 26 weeks, with decoding near 80% against 14.3% chance. That chance level equals 1 ÷ 7, which implies seven tone classes (our inference).
CorTec posted the closest counterpart on Oct 21, 2026: epidural µECoG arrays in two macaques, published in the Graz BCI Conference proceedings, with 63 of 64 contacts still working and analysed time points up to day 1,361 (1,361 ÷ 365.25 = 3.7 years). One contact failed at about 14 months. The task was a visual-motor reaction task and the criterion was usable signal and alert-versus-drowsy contrast. Different animal, route and criterion, so the two "four-year" claims are not a ranking.
Neuralink's N1 has 1,024 electrodes on 64 threads in early implants and 128 thinner threads later, according to Neura Pod. After the 2024 thread retraction, Neuralink reported higher signal quality in 18 of the next 20 participants (date not stated, secondary). Its Oct 1 update claimed over 50,000 hours of human recordings, used to train decoding models. Explainx describes a "3,000-channel signal view" in the VOICE video. We follow 1,024 electrodes and leave the conflict unresolved. VOICE has no peer-reviewed accuracy or latency benchmark.
Precision's preprint atlas puts a scale on the surface route: 87,000 ÷ 70 ≈ 1,243 microelectrodes per patient and 180 ÷ 70 ≈ 2.6 h per patient, from a device cleared only for temporary use. Neuralink's 50,000 h is about 278 times more hours (50,000 ÷ 180), but from chronic implants, so it measures a different thing. Synchron's Stentrode has 16 electrodes, 64 times fewer than 1,024, which BCI Briefing links to clicks and menu selection rather than cursor or speech rates; its peer-reviewed safety paper is from 2023 (context).
4.3 Ultrasound and non-invasive: mostly pre-human numbers
Butterfly Network announced on Sep 1, 2026 a multi-year licence giving Merge Labs its Poseidon ultrasound-on-chip, with Butterfly as exclusive CMOS-MEMS ultrasound partner. According to Startup Fortune, Bridge Neurotech announced a similar Butterfly licence on Oct 6 and a first human study in Redwood City, with no performance figure. Gestala's first product is still in development and clinical preparation, per Yahoo Finance. Neither company has published a decoding number in the material.
Ultrasound reads blood flow, not spikes. A Tencent News explainer (Aug 21, 2026) says functional ultrasound resolves about a hundred micrometres, but the monkey decoder it describes ran on 2 Hz images, one frame every 0.5 s (1 ÷ 2), so the ceiling is vascular lag, not hardware. The same explainer credits Chinese firms with 1.5 mm focusing (BCI-Sonics) and under 1 mm over 57 cases (Futong Huizhi), and a Tianjin model cutting skull-field prediction from 96.65 s to 28.30 ms. These are company or secondary claims.
Non-invasive EEG is further back. The subject-independent imagined-speech baseline reached 49.03 ± 4.18% on coarse classes, and EEGNet under attack stayed near 22 to 24%. Both are preprints, and Neural Noise calls them baselines, not solved communication. The material has no technical results for Cognixion or NextSense.
4.4 Comparing like with like
The same BEST decoder scored a 6.19% word error rate on Brain-to-Text '24 and 1.62% on '25, a 3.8-fold gap (6.19 ÷ 1.62) from the benchmark alone; it is an arXiv preprint. UCSF's 62 words per minute used a 50-word vocabulary in 2021, and its 9.1% error rate used 125,000 words. The Parker Jones lab notes that accuracy and WER ignore vocabulary size, and a September survey compares results only within reported protocols. Our rule: compare only the same task, vocabulary, species and measurer. Under it, this quarter's durability results stand as separate claims, and Neuralink's 11.32 bits/s is a cursor figure that says nothing about speech.
5. Funding and companies
Chapter 4 compared the technical routes by their metrics; this chapter follows the money behind them, from Precision's $250 million round to China's IPO queue. All dates are judged against 2026-10-24.

5.1 Precision's round, and the US picture
Precision announced a Series D on Thursday, Sep 24, 2026. MedTech Dive was published on Sep 25 and says "Thursday", and New Market Pitch dates the deal Sep 24. Fierce Biotech and citybiz are dated Sep 28, and MedTech World dated its write-up Oct 9. We follow Sep 24 and treat the later dates as coverage dates.
The round was co-led by Pershing Square, the Ackman Oxman Institute and an undisclosed life-sciences fund. It also drew Duquesne Family Office, B Capital, ARK Invest, Invus, Mubadala Capital, Mirae Asset Capital, Korea Investment Partners, Hitachi Ventures and JSL Health Capital. Total funding is $430M, so earlier capital was 430 − 250 = $180M. Proceeds go to the clinical programme, further FDA review of Layer 7 and commercial infrastructure; trial and regulatory facts are in Chapters 2 and 3.
Only Tech Funding News gives a valuation, "just over $1 billion", with Pershing Square and the Institute contributing $42.5M (about 17% of the round). We treat both as press-reported. New Market Pitch's tracker lists a total of about $467M, against the company's $430M; we follow $430M.
Neuralink has announced no new priced round in the window. Its last disclosed round is the Series E of mid-2025: $650M, though Tech Funding News says $600M. Reports also differ on whether $9B was pre- or post-money. We follow pre-money, since $9.0B + $0.65B = $9.65B post-money matches. Oman Investment Authority joined an undisclosed Series E extension on May 8, 2026, before the window. Higher figures are all estimates from secondary-market activity:
- $29–42B (reported);
- $24–29B (New Market Pitch);
- $25–32B (New Market Pitch, a different page).
Nasdaq Private Market puts the per-share estimate at $240.03 on Aug 25, 2026, and no IPO has been announced. These are not transaction prices.
Merge Labs launched in January 2026 with a $252M seed from OpenAI, Bain Capital, Interface Fund, Fifty Years and Gabe Newell. On Sep 1, 2026 it signed a multi-year licence with Butterfly Network that includes upfront and milestone payments and hardware purchase commitments (amounts not disclosed). Its valuation is a tracker estimate of $820–880M. Science Corp ($230M Series C, March 2026, $1.5B) and Synchron ($200M Series D, November 2025) fall before the window.
5.2 China: more deals, smaller cheques, and the first listings
China led on deal count and the US on dollars: of 72 BCI financings since January 2024, 44 were Chinese and 18 American, yet the US took 63.4% of measured capital.
Gestala's two rounds are RMB 150M (March) plus RMB 420M (July): 150 + 420 = RMB 570M, about $84M. The RMB 420M Angel+ was announced on Jul 3, three weeks before the window, and led by Huaying Capital. Gestala says it will unveil a first-generation ultrasound system and publish initial clinical data by end-2026 (plan, not delivered).
Inside the window:
- BCI-Sonics raised RMB 200M (Pre-A, Sep 22, led by Sequoia China and Yunqi Capital). 200 ÷ 28 ≈ 7.1 RMB per dollar, consistent with the ~$28M in.
- GenLight announced consecutive Series C and D rounds of several hundred million RMB in September.
- Active Technology (~$46M Angel, Aug 3) and Mindtrix (August) are further large rounds.
Labels conflict: one tracker calls BCI-Sonics a Seed, and Mindtrix is $49M or $52M. We follow the two sources that say Pre-A and give both Mindtrix figures. For H1 2026, Neurofounders counted 34 Chinese BCI financings with disclosed funding above RMB 4bn, and 13 neurotech(-adjacent) rounds of at least RMB 100M across 12 companies.
Listings are the new channel:
- Shuli Innovation entered STAR Market IPO counselling on Sep 4.
- Neuracle's RMB 2.5bn STAR application was accepted in June.
- BrainCo reportedly filed confidentially in Hong Kong (Bloomberg, via Neurofounders).
According to BigGo Finance's reading of Neuracle's updated prospectus (Sep 29), NEO-ONE SCI earned no revenue in the reporting period, and its first commercial sale was in July 2026. Cumulative sales were 13 units at RMB 475,000, so 13 × 475,000 = RMB 6.175M, about 0.25% of the RMB 2.5bn target. The prospectus itself is not in our material; pricing and reimbursement are in Chapter 3.
5.3 What the trackers count
Four trackers give totals from $1.63B to $4.95B because they count different things, so their totals cannot be added or compared.
| Tracker (date) | Scope and definition | Count | Amount | Source |
|---|---|---|---|---|
| New Market Pitch BCI (Oct 6) | Brain activity to commands: invasive, non-invasive, decoding software, interface hardware; excludes imaging and muscle-controlled interfaces; since Jan 2024 | 72 financings, 55 companies | $2.816B | — |
| New Market Pitch neurotech (Sep 14) | All neurotechnology; BCI is 31.4% of deals | 204 deals | $4.95B | — |
| Neurofounders H1 (Aug 9; revised Aug 13) | 363 Startup Map companies; includes grants, debt, public-market deals | 81 events (revised 82) | $2.64B (revised $2.66B) | — |
| New Market Pitch pure-play (Jul 13) | Equity rounds ≥ $300K, Aug 2025–Jul 2026 | 26 deals | $1.63B | — |
The same publisher's two 2026 trackers do not reconcile: 31.4% × 204 ≈ 64 BCI deals, against 72 in the BCI tracker. Within, deals rose from 10 (2024) to 21 (2025) to 41 (first nine months of 2026), and 10 + 21 + 41 = 72. The median round is $20.8M and the average $56.3M, and 2,816 ÷ 56.3 ≈ 50 rounds with a disclosed amount. Another page counts 41 financings across 35 companies against 11 a year earlier, with 17 of the 41 lacking a precise amount; its comparison window is not stated. Neurofounders' H1 BCI total was about $690M, of which Merge Labs and Science made 252 + 230 = $482M, about 70%. Trackers are secondary estimates, so use them for trend, not as audited totals.
6. Ethics and safety
Chapter 5 followed the money into the field; this chapter covers what the same devices do to the data and people they touch, and which rules and safety evidence existed on Oct 24, 2026.
6.1 Items in the window
| Item | Key figure | Date | Status | Source |
|---|---|---|---|---|
| iBCI data-protection review | 5 gaps | Jul 27, 2026 | Published | Communications Medicine |
| OECD Paper No. 195, Neurodata governance | 16 companies mapped | 04/09/2026 (as printed) | Published | OECD |
| NMPA AI-BCI EEG data standard | Effective Sept 1, 2027 | Mid-Sept 2026 | Issued, not in effect | According to TechTimes |
| California AB 1883 | Assembly passed May | Aug 19, 2026 | Pending | Bloomberg Law |
| US MIND Act (S.2925) | FTC study | Oct 16, 2026 | Awaiting committee | The Transmitter |
| Neuralink safety record | 0 serious adverse events, 21 participants | Jan 28, 2026 | Company-reported | Neura Pod |
Neural-data rules multiplied during the quarter, but the only implant safety figure in the material is the developer's own: 0 serious device-related adverse events among 21 participants, reported in January 2026 and not independently confirmed.
6.2 Neural-data law: a patchwork still defining its terms
In the US, protection comes from state consumer-privacy laws. According to an opinion piece in The Transmitter (Oct 16, 2026), California and Colorado amended their privacy acts to define brain data by its origin in the nervous system, Connecticut added neurodata to its sensitive-data list, and Montana folded "neurotechnology data" into its Genetic Information Privacy Act. The definitions diverge: California excludes data inferred from non-neural information, Colorado does not, Montana excludes pupil dilation and breathing rate, and Connecticut covers only the central nervous system. CalMatters says Alabama, Illinois, New York, Vermont and Virginia were considering bills in 2026.
California is the live test. It classed neural data as sensitive personal information in 2024. AB 1883 would bar, with exceptions, employer use of surveillance tools that collect neural data. The Assembly passed it in May 2026 and the Senate was still considering it on Aug 19, 2026; the material does not show the outcome since. Federal action is a study, not a rule. The MIND Act, introduced Sept 24, 2025 by Senators Schumer, Cantwell and Markey, would direct the FTC to study neural data for a year, and it was "still awaiting committee action" on Oct 16, 2026.
Two analyses argue the definition fight is a distraction. A Neuroethics article assessed 47 consumer wearables from 30 companies and found that differing definitions of "neural data" produce differing protection; it favours regulating outcomes of data use over data origin (2026, date not stated). The Transmitter piece agrees, citing Chile's 2023 Supreme Court ruling against Emotiv, decided on existing privacy rights, not the 2021 neurorights clause (pre-window). The commercial risk is documented: the Australian Human Rights Commission found that 24 of 30 consumer neurotechnology companies (80%) had policies allowing potential sale of neural data (date not stated).
Internationally, UNESCO member states adopted the Recommendation on the Ethics of Neurotechnology in November 2025. Implementation events followed: a UNESCO panel in Johannesburg on Jul 10, 2026 (pre-window, reported Aug 24) and a two-day Abuja roundtable reported on Oct 8, 2026. The OECD paper warns that overlapping neurodata frameworks make compliance hard and may overlook high-risk uses. According to TechTimes, China's NMPA issued a standard covering collection, processing, labelling, storage and access for EEG data used by AI-enabled BCI devices, effective Sept 1, 2027, about 10 months after Oct 24, 2026. See Chapter 3 for China's approvals.
6.3 Implants: data rights, consent and safety evidence
The most specific proposal for clinical devices is the Communications Medicine review by Julian Sandbrink (Harvard Medical School) and Michael Young (Mass General Brigham), published Jul 27, 2026. It finds iBCI data under-protected despite HIPAA and GDPR, naming five gaps: reliance on conventional de-identification, limited individual control, conflated consent, weak misuse guardrails and unclear ownership. Its remedies, such as separate data consent and limits on secondary use, are proposals, not rules. Consent is the weak point in practice: at the Johannesburg panel, Roseline Dzekem Dine noted that participants may agree because they trust a doctor, not because they grasp future data use.
Safety evidence is thin and mostly company-reported. Neuralink reported on Jan 28, 2026 "zero serious device-related adverse events" among 21 participants. The one documented device problem is thread retraction in the first participant (2024); Neuralink says signal quality rose in 18 of the next 20 participants (90%) after changes. No independent adverse-event data appear in the material. Data from the first three participants went to the New England Journal of Medicine, but no paper was published as of October 2026. For its VOICE speech trial (NCT07224256), Neuralink has not published peer-reviewed accuracy or latency benchmarks. According to Neura Pod, critics also cite Reuters' 2022 report of about 1,500 animal deaths since 2018, a June 2023 FDA inspection of the company's animal lab, results announced on X rather than in journals, and an initial absence from ClinicalTrials.gov. Synchron's four early participants completed 12 months with no serious adverse event, vessel occlusion or device migration (JAMA Neurology, 2023, pre-window); devices and definitions differ, so the two should not be ranked.
Continuity of care is the least evidenced topic. The material contains no 2026 case of a company withdrawing support from implanted users. It offers one precedent: Cyberkinetics, which launched the first BrainGate trials, went bankrupt before reaching a product (a Med-X perspective, date not stated). The only forward commitment found is Neuralink's PRIME study, which follows each participant for about 6 years, including 5 of long-term follow-up (company brochure, via Neura Pod). The judgement for developers is that data governance, not device safety, is where rules are moving. Separate data consent and limits on secondary use are the gaps named most often.
7. Outlook and what to watch
Chapters 2 to 6 covered trials, regulators, technical routes, funding and ethics. This chapter asks how far each route still is from approval and daily use, what changed for each reader, and which dated events come next. It uses only facts from those chapters and gives no medical or investment advice.
7.1 How far each route is from daily use
No implanted BCI gained new market access in the window (Chapter 3), so every route below is still investigational unless stated.
- Intracortical. Neuralink reports 21 PRIME participants (Jan 28, 2026) and a third VOICE speech participant, with no peer-reviewed speech benchmark. Paradromics has implanted 1 of up to 10 Connect-One participants, 10% of planned enrolment (1 ÷ 10), and the FDA letter of Aug 26 widened the devices it may connect to.
- Endovascular. Synchron's INTENT study plans 10 participants at 5 US sites, and a pivotal trial is reported as planned for 2026, not confirmed by a company filing in the material.
- Surface. Precision's Layer 7 is cleared for up to 30 days of use, further FDA review is pending, and its Series D brought total capital to $430M. CorTec holds two Breakthrough Device Designations, which are not approvals.
- Ultrasound and non-invasive. Merge Labs and Bridge Neurotech licensed Butterfly's chip, Bridge is enrolling its first human study, and neither has published a decoding number. The EEG imagined-speech baseline of 49.03 ± 4.18% is a preprint on coarse classes.
- China. Neuracle's NEO has NMPA Class III registration (Mar 13, 2026) but 13 units sold and no place in the insurance catalogues.
7.2 What changed and what it implies, by reader
| Reader | What changed | Implication | Evidence |
|---|---|---|---|
| Patients and clinicians | Speech results arrived as single-participant company demonstrations; Chinese access exists but is largely self-paid | Treat speech claims as early evidence; in China the 475,000 yuan list price is met only partly by a supplementary scheme worth at most 142,500 yuan | — |
| Device developers | FDA letter widened investigational connectivity; designations stack up; China issued an EEG-data standard effective Sep 1, 2027 | The US gates remain designation, IDE and later review; data preparation rules are arriving in China before the standard binds | — |
| Payers | CMS took comments on a Neuralink coding request to Oct 16; RAPID is only proposed | A code request does not create coverage, so reimbursement lags authorisation | — |
| Investors and analysts | $250M Precision round; China leads deal count, the US capital; tracker totals run $1.63B to $4.95B | Read tracker totals for trend only; Neuralink valuations above its $9.65B post-money round are estimates, not transactions | — |
| Data-governance teams | A review names five gaps in implantable-BCI data protection; US neural-data definitions diverge by state | Data consent and secondary-use limits are where rules are moving, ahead of device-safety rules | — |
The quarter moved the field from demonstration to infrastructure: speech and durability results, money and coding requests all advanced, but none of them is an approval, a coverage decision or an independently verified outcome.
Three open items decide how fast that changes. First, whether a speech result is published with an error rate and a defined task, since none of this quarter's headline results has one. Second, whether Synchron's pivotal trial and Precision's further FDA review are confirmed by the companies or the agency. Third, whether Neuracle's listing proceeds against 6.175 million yuan of cumulative sales (13 × 475,000) and a 2.5bn yuan target.
